NOTICE is hereby given that on February 04, 2022, resubmitted May 20, 2022, Troutstalker Ranch, LLC., 223 N. Guadalupe # 253, Santa Fe, NM 87501, filed with the STATE ENGINEER Application No. 1974-53 for Permit to Change Purpose of Use and Add a New Point of Diversion of Surface water of the Rio Chama Stream System within the State of New Mexico.
Rio Arriba County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Española Rio Grande Sun.
The Applicant proposes to change the point of diversion (POD) for a portion of water right SP-1974-53, priority date 1931, from SP-1974, located at 358284 E, 4085641 N and SP-1974-POD2, located at 360170 E, 4087436 N, both UTM 13N, to a new surface point of diversion located at 357561 E, 4080793 N, UTM 13N. The intent is to change the purpose of use of the water right appurtenant to 2.13 acres on the expanded footprint of the declared livestock impoundment within subfile CHCV-004-0002(A). The associated 2.24 afa consumptive right is intended to offset a portion of the annual evaporative losses of the pond, which serves the purposes of fire suppression, livestock, recreation, and irrigation and is the subject of a concurrent application submitted February 04, 2022.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Detriment: if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water: if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, at the District 6 Office or by mail at PO Box 25102, Santa Fe, NM 87504-5102, on or before August 12, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 827-6682. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
