NOTICE OF SALE

NOTICE IS HEREBY GIVEN to the above-named Defendants, and all others interested, that the undersigned Special Master will, on October 30, 2020 at the hour of 11:00 a.m. at the main entrance of Espanola City Hall at 405 Paseo de Onate, Espanola, New Mexico 87532, offer for sale, sell, and convey all the right, title, and interest of LOS ALAMOS NATIONAL BANK and of the above named Defendants to the highest bidder, for cash, the following described real property and improvements located in Espanola, Rio Arriba County, New Mexico and more particularly described as follows:

A certain tract or parcel of land lying within and being a portion of Exc. 12, Exc. 27 and PC 154 within the San Juan Pueblo Grant in Section 26, T21N R8E, NMPM, in the vicinity of Ranchitos, as shown on plat of survey entitled “Survey Requested by Richard Ralph Herrera, Jr.”, as prepared by Gilbert R. Valdez, PLS No. 12175, dated August 1994 and filed for record August 29, 1994 in Book of Plats O-76 at page 3185, records of Rio Arriba County, New Mexico. Containing 0.3567 acres, more or less.

more commonly known as 610 Calle Amorada, Espanola, NM 87532 (“Subject Real Property”).

Said sale is to be held pursuant to the Stipulated Judgment, Default Judgment, Decree of

Foreclosure, Order of Sale and Appointment of Special Master ("Judgment") entered on May 31, 2018 wherein Plaintiff LOS ALAMOS NATIONAL BANK sought to foreclose its Mortgage on the Subject Real Property and was granted judgment against the Defendants CARLOS M. SANCHEZ, ANTONIO SANCHEZ and ROSE SANCHEZ and the Subject Real Property in the total amount of $53,625.18 as of May 31, 2018 which judgment is on a valid mortgage lien encumbrance, plus additional awarded interest at the rate of 3.62% per annum from May 31, 2018 to the date of sale in the amount of $4,277.52, additional awarded attorney’s fees incurred after May 31, 2018 to the date of sale, the Special Master’s fee, costs of publication of the notice of sale and any amounts which may be incurred to preserve and conserve the Subject Real Property from May 31, 2018 to the date of sale. The Plaintiff LOS ALAMOS NATIONAL BANK has the right to bid first all or any part of the judgment awarded it herein and may apply same as a credit and the sale is subject to a one (1) month right of redemption.

NOTICE IS FURTHER GIVEN that the Subject Real Property and improvements thereon will be sold subject to any and all patent reservations, easements, encroachments, rights of way, restrictions, all recorded and unrecorded liens not specifically foreclosed herein and all recorded and unrecorded special assessments and taxes that may be due. Plaintiff LOS ALAMOS NATIONAL BANK and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the Subject Real Property subject to any and all unpaid real property taxes, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the Subject Real Property, deactivation of the title to a mobile or manufactured home on the Subject Real Property, if any, environmental contamination on the Subject Real Property, if any, and zoning violations concerning the Subject Real Property, if any.

NOTICE IS FINALLY GIVEN that the Special Master may continue the sale from time to time if necessary without republishing the Notice of Sale so long as the Special Master or his designee appears at the designated time scheduled for said sale and announces the postponement thereof to another specific date.
