NOTICE is hereby given that on September 27, 2020, Brazos Mutual Domestic Water Consumers Association (BMDWCA), PO Box 92945 Albuquerque, NM 87199, filed with the STATE ENGINEER Application for Permit to Add An Additional Point of Diversion of Groundwater to RG-24272 et al. within the Rio Grande Underground Basin of the State of New Mexico. Applicant submitted a corrected application on October 4, 2021.

Rio Arriba is the County affected by the diversion and in which the water will be put to beneficial use. This notice is ordered to be published in the Rio Grande Sun.

The applicants propose adding existing exploratory well RG-90587 located at X=371,465 meters and Y=4,067,493 meters, UTM, NAD83, Zone 13N, in the Tierra Amarilla Grant, to existing PODs RG-24272 located at X=371,294 meters and Y=4,067,574 meters; RG-24272-S located at X=372,107 meters and Y=4,067,837; and RG-24272-S-2 located at X=371,468 meters and Y=4,067,500 meters; all coordinates in meters, UTM, NAD83, Zone 13N, for the total diversion of 48 acre-feet per annum from all wells for the purpose of community type uses by members of the BMWDCA within the service area of the BMWDCA on lands owned by its various members. No increase in total diversion is requested with this application. The priority date of the Applicant’s water right is March 12, 1963. The Applicant has an additional application on file and past public notice, but not yet approved, to add exploratory well RG-98351 located at X=372,027 meters and Y=4,067,805 meters UTM, NAD83, Zone 13N.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, Office of the State Engineer PO Box 25102 Santa Fe, NM 87594, on or before December 31, 2021. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer at 505-827-6682. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
