NOTICE is hereby given that on May 7, 2019 DJR Nominee Corporation, 1700 Lincoln St. Ste. 2800, Denver, Colorado 80203, filed with the New Mexico Office of the State Engineer a Notice of Intention to drill six (6) wells to appropriate nonpotable groundwater from an aquifer the top of which is at a depth greater than 2,500 feet pursuant to NMSA 1978 §§ 72-12-25 and 27. Notice of Publication was run in the Farmington Daily Times on June 15th, 22nd, and 29th 2019, and the Rio Rancho Observer on June 16th, 23rd, and 30th 2019 in accordance with statute. This is a re-publication of notice for two of the six wells. DJR Nominee Corporation has requested a change in location for the Crow Canyon WSW (OSE File No. SJ-4345) and the Betonnie Tsosie WSW (OSE File No. SJ-4347). The Crow Canyon WSW’s location is being changed from the published location in the NE/4SE/4 of Section 17, T24N, R 8W, San Juan County, NM, to the new location in the NE/4NE/4 Sec. 29, T 22N Range 7W, Sandoval County, NM. The Betonnie Tsosie WSW’s location is being changed from the published location in the NW/4SW/4 of Section 14, T 23N R 8W, San Juan County, NM, to the new location in the NW/4SW/4 Sec. 29, T 22N Range 6W, Sandoval County New Mexico. DJR notified the NM Office of the State Engineer by letter dated June 7, 2021 of this change in location. The Crow Canyon well will be drilled to an anticipated depth of 6834 feet, and will be constructed with 7.6 inch outside diameter casing. The well will have water production isolated within the Entrada Sandstone Formation Aquifer. The Betonnie Tsosie well will be drilled to an anticipated depth of 7175 feet, and will be constructed with 7.6 inch outside diameter casing. Both wells will have water production isolated within the Entrada Sandstone Formation Aquifer. The wells will be located between 7 and 10 miles southwest of the town of Counselor, New Mexico, in the northwest portion of Sandoval County, New Mexico. The wells will each have an estimated annual production of 200-450 acre-feet, with the total annual diversion from all six wells not to exceed 2,700 acre-feet, for a period of (20) twenty years. The Applicant proposes to re-inject 40-90% of the water withdrawn back into the Entrada Formation. The proposed purpose of use of the water is for industrial use, specifically for oil and gas operations. The proposed place of use is lands under state, fee, federal and tribal ownership in all of San Juan, Rio Arriba and Sandoval Counties, New Mexico. The points of diversion are located on BLM lands. Any person may bring an action in the district court in the county in which any such well is situated for damages or injunctive relief with respect to any claimed impairment of existing water rights due to an appropriation of nonpotable water under NMSA §§ 72-12-25 to 72-12-28. Applications to appropriate nonpotable water under § 72-12-28 are not subject to protest or hearing before the State Engineer.
