NOTICE OF SALE

NOTICE IS HEREBY GIVEN that the undersigned special master will on July 2, 2021, at the hour of 10:00 AM, at the front Entrance of the Espanola Magistrate Courthouse located at 1127 Santa Clara Peak Rd., Espanola, New Mexico, sell, convey, to the highest bidder for cash all the right, title and interest of the above named defendant in and to the following hereinafter described real estate located in Rio Arriba County, State of New Mexico, and is particularly described as follows:

Lot Eight (8) of Apple Valley Estates, City of Espanola, County of Rio Arriba, State of New Mexico, according to the plat Thereof recorded in the office of the County Clerk of Rio Arriba County,

And

The .27 acre lot.

The address of the property is 501 Ramon Drive, Espanola Apple Valley, New Mexico 87532. Plaintiff does not represent or warrant that the stated street address is the street address of the described property; if the street address does not match the legal description, then the property being sold herein is the property more particularly described above, not the property located at the street address; any prospective purchaser at the sale is given notice that it should verify the location and address of the property being sold. Said sale will be made pursuant to the Amended Default Judgment, Decree of Foreclosure, And Appointment of Special Master entered on January 11, 2021 in the above entitled and numbered cause, which was a suit to foreclose on a judgment lien held by the above Plaintiff and wherein Plaintiff was adjudged to have a judgment lien against the above-described real estate in the amount of $103,542,81 as of the date of October 10, 2013, plus interest thereafter at the rate of 8.75 % per year until the date of Special Master’s sale, plus attorney fees, Special Master fees, costs of this action, costs of publication and those additional amounts, if any, which Plaintiff will be required to pay prior to sale. As a result of the Bankruptcy Order in the United States Bankruptcy Court, District of New Mexico, Case No. 13-10-11101-JA, no deficiency judgment will be awarded to Plaintiff if the sale price is less than what is owed to Plaintiff under the judgment set forth herein. Plaintiff has the right to bid at said sale and submit his bid verbally or in writing. The Plaintiff may apply all of or any part of his judgment to the purchase price in lieu of cash. The successful bidder is put on notice that that they will be obligated to pay the current owner’s exemption in the amount of $60,000,00 to Rosina Martinez prior to taking possession of the property.

In the event the Special Master is unable to conduct the sale when scheduled, he may designate a successor to act as Special Master. Without further notice said successor may conduct the sale, notice of which may have been published in the name of the original Special Master. The Special Master is empowered to postpone the date and time of the sale in the event the event he deems such postponement advisable, and may sell the Property at such postponed public sale on the terms set forth herein.
