Police tape marks the boundaries of the crime scene being investigated Thursday following a fatal shooting at an Española gas station.

    Española Police detectives charged two men with an open count of first-degree murder, attempted first-degree murder and aggravated assault following an incident Thursday (6/29) night at the Giant gas station.

    Daniel Suarez, 21, of La Puebla and Jonathan Avila-Cisneros, 18, of Santa Fe, were arrested by Officer Ernest Saucedo following a traffic stop after the alleged shooting.

    One of them allegedly shot Nicholas Kaye, 17, of Ohkay Owingeh following a fight at the gas station.

    It appears both men are being held without bond. They had a first appearance at 1:30 p.m., Friday, in front of Española Magistrate Judge Alexandra Naranjo.

    The open first-degree murder count is a capital crime while attempted first-degree murder is a second-degree felony and aggravated assault with a deadly weapon is a fourth-degree felony.
