2 Plead Guilty in Beating, Shooting Case

Two men pleaded guilty to charges in a beating case where they broke a man’s teeth and jaw, leaving him with injuries so severe, he was taken to a hospital in Albuquerque for his trauma.
Elier Perez, 31, and Luis Perez, 37, both pleaded guilty in the beating case while the aggravated battery causing great bodily harm case against a third man, Carlos Escarcega, 28, of Española, is still pending. The Perezes are from Medanales.
Both men are also known in court records by the last name Perez-Mariscal. Their relationship is not outlined in court records.
Elier Perez pleaded guilty on March 3 to a single count of aggravated battery causing great bodily harm and per his plea deal, he received a conditional discharge. He will be on supervised probation for three years, but if there are no problems, he can ask for his probation to become unsupervised. At the end of the three years, with no violations, the charge against him will be dismissed.
Among the conditions of his probation are no drinking and no firearms possession.
Luis Perez pleaded guilty on March 17 to a misdemeanor charge of battery, a step down from the aggravated battery causing great bodily harm charge initially levied against him. He received a suspended six-month sentence, to be spent on supervised probation.
Rio Arriba Deputy Cameron Chavez arrested Carlos Escarcega, Elier Perez and Luis Perez on July 15, after the pair beat Marcos Madrid, breaking his teeth and jaw. Madrid had to be taken to a hospital in Albuquerque for his injuries. While Elier and Luis Perez have admitted to the brutal beating, Escarcega’s case is ongoing.
Chavez wrote in a criminal complaint for all three men that on July 15, he was initially called to Carmen Perez’s house for an assault. Luis Perez initially told deputies that Madrid “got hostile towards everyone and was physically fighting with them” and then his mom came and picked him up.
When deputies saw Madrid’s injuries, they could see he was badly injured, bleeding from his mouth, one of his bottom teeth was “still intact by the root of the tooth,” he had a bump above his left eye and complained of jaw pain, Chavez wrote.
Medics later determined that his jaw was broken. While he was initially taken to the Española hospital, he was transferred to Albuquerque due to the severity of his injuries, Chavez wrote.
Madrid told the deputies while they waited for medics that he was invited to drink at Carmen Perez’s house. Luis Perez picked him up and they were drinking beer, having a good time “when all of a sudden Luis, Carlos and Elier had started to confront him about bad talking one of their friends,” Chavez wrote.
Once they “became hostile” they started punching him, took him to the ground and began kicking him, Chavez wrote.
He ran away and called his mom to pick him up. When she and his uncle picked him up, she saw Elier Perez walk to his vehicle and heard a round being chambered in a gun, while the victim’s sister told Chavez that the three kept trying to fight with her brother as she tried to get him out of the house, Chavez wrote.
She told them that she also heard a round being racked into a gun and Elier Perez yelling, “Everyone get off my property” right after, Chavez wrote.
When deputies got to the house, Escarcega allegedly ran from deputies, jumping out of a second-story window.
